Field Sobriety Tests

Refusing a Field Sobriety Test

Field sobriety tests are open to human error and other variables which demand they be reviewed in any DWI case. It can happen that an injustice occurs because improperly conducted or falsely judged field sobriety tests were never detected. It is therefore very important that your Liberty County DWI attorney review specific details regarding these tests in your case. If you have been arrested for DWI, do not make any statements to police until you have an attorney present. It can too easily occur that statements are made which you do not realize act against you in some capacity. Therefore, simply tell the police you wish to exercise your right to an attorney and do so immediately.

Liberty County DWI Lawyer

Having been successfully defending clients in DWI cases since 1998, Attorney Doug Atkinson has great familiarity with all aspects of such cases. His firm grasp of the intricacies of the law means he can address your case energetically and competently. The factors he will review regarding any field sobriety tests administered include:
  • Were the tests used federally approved tests?
  • Were the tests conducted in a fair manner, with clear instruction given?
  • Did any behavior of the police officer involved indicate that he or she was not operating from an impartial position?
  • Did road conditions or weather conditions prevent you from being able to carry out the test competently?
  • Were you suffering from any physical condition or disability which interfered with your ability to execute the tests?
  • If you refused to take part in the tests, were you advised as to the consequences of doing so?

Where any of these points cast reasonable doubt upon the validity of the test results, the court must give this information the weight it demands and act accordingly. Your attorney will do everything possible to fight for your rights and future.

Contact a Liberty County DWI lawyer, who can review the field sobriety tests conducted in your case and determine if any related factors may be used in your DWI defense.
